Duration of copyright

If a photograph is in copyright, then the copyright owner holds the rights to reproduce and publish the photograph. Since 1 January 2005:

  • if the photographer is unknown or used a pseudonym, duration continues indefinitely until the photograph is published. Once it is published, duration will then last until 70 years from the end of the year in which it was published
  • where a Commonwealth, State or Territory Government owns copyright in a photograph, the work is protected by copyright for 50 years from the end of the year in which it was first published
  • all photographs taken before 1 January 1955 are now out of copyright
