Update - Post Exhibition Planning Proposal

On Monday 26 June 2023 the City of Sydney (CoS) Council resolved to approve the Post Exhibition Planning Proposal for 118-130 Epsom Road and 905 South Dowling Street, Zetland. Following consideration of submissions, the following key changes to the exhibited planning controls have been endorsed by the City of Sydney:

  • additional requirements in the DCP, to guide future consideration of traffic and transport and flooding matters at the concept development application stage;
  • amendments to the car parking requirements in the draft DCP to remove conflict with the LEP requirements;
  • increasing the maximum permitted gross floor area for the purposes of shops from 1,000 square metres to 1,200 square metres to resolve an identified shortfall of supermarket floor space in the area; and
  • reversion to the current DCP's active frontage requirements to align with the LEP's minimum non-residential floor space requirement.

CoS Council also resolved to note the matters raised in response to the public exhibition and to prepare and exhibit an amended draft planning agreement.

The amended draft planning agreement revises the public benefit offer to include the on-site delivery of approximately 2,194 sqm gross floor area (around 25 affordable housing dwellings) and a retail space in a standalone building in perpetuity. The affordable housing building is to be dedicated to a housing Community Housing Provider (CHP).

Draft Proposal

The City of Sydney (CoS) has prepared a draft planning proposal and draft DCP in response to Meriton’s request to amend planning controls at the old Holden Suttons site at 118-130 Epsom Road and 905 South Dowling Street, Zetland.

The proposed changes to the planning controls seek to:

  • Increase the current maximum building height control over parts of the site under Alternative Height of Building controls. Heights range between 11m and 90m
  • Require a minimum proportion of floor space be provided as non-residential floor space
  • Apply higher sustainability standards for all affected development
  • Not increase the overall floor space ratio (FSR) approved on the site.

The draft planning proposal and draft DCP were considered at the CoS Council meeting on the 12 December 2022, where it was endorsed for submission to the Department of Planning and Environment for Gateway Determination and public exhibition.

The proposal was subsequently submitted to the Department in late December 2022 and received Gateway Determination on the 2 March 2023.

The next stage of the planning process is that the Sydney City  Council will  forward the proposal to the Department for finalisation of the legislative changes to the planning controls.

Public Exhibition

The draft Planning Proposal, draft DCP and draft planning agreement were on public exhibition for a 6 week period between 27 March and 8 May 2023. The exhibition period is now closed.

Randwick Council offices have reviewed the draft planning proposal and have prepared a report to the 23 May 2023 Council meeting with a draft submission responding to the potential impacts of the proposal.

Following the outcome of the 23 May meeting, Randwick Council will forward the endorsed submission to the CoS. The CoS will then consider all stakeholder and public submissions to the draft planning proposal and make changes to the draft planning proposal as required.
