S94 and S94A Development Contributions Plan

Section 94 of the Environmental Planning and Assessment Act 1979 provides a system for requiring contributions when a development takes place. These contributions are levied by councils on new developments to ensure that growing and changing communities have adequate public amenities and services. Development contributions (monetary or in-kind) can be used to help provide for parks, local road improvements, town centre improvements, community centres and other services.

Randwick City Council has developed a Section 94A Plan and a Planning Agreements Policy  for the application of these contributions in the Randwick area. Copies of these Plans can also be purchased for $27.50 (GST inclusive). Please contact us.

Section 94A Plan

The Randwick City Council Section 94A Development Contributions Plan came into effect on 2 July 2007 and is applicable to development applications lodged from that date.

A site specific plan applies to the Department of Defence site at Bundock Street, Randwick.

Planning Agreements Policy

Planning agreements are one of a number of alternative mechanisms noted under Council's S94A Plan for developers to contribute to public facilities in Randwick City. Council's Planning Agreement Policy (pdf 122kb) establishes a framework to guide the preparation of planning agreements in a manner that is efficient, fair, transparent and accountable.
